These Terms & Conditions (“Agreement”) apply to the services provided by Claimstream. By accessing or using our services, you are agreeing to be bound by these Terms & Conditions outlined herein and any further agreements made by you and our team in order to provide you with your tailored services.
Claimstream provides specialised legal and claims management services to entities in need of support with their Large Loss Commercial Recoveries Portfolio. By partnering with your business, Claimstream provides a comprehensive and transparent claims solution that may include, but is not limited to:
Deployment of our highly specialised legal professionals to manage your claims portfolio;
Full integration with your operational structure and reporting lines (as required);
Complete cost assumption of litigation activities, including court fees, expert reports, and legal representation;
Full risk coverage for adverse cost orders or unfavourable litigation outcomes;
Ongoing collaboration and transparency in decision-making processes, ensuring that you retain control and oversight at all times;
Delivery of regular reporting and insights on claims progress and outcomes;
Scalability to match your business size and operational requirements.
Individual contacts or service agreements will further outline the details of the services, pricing, timelines and scope of services subject to your individual circumstances.
These agreements will be executed by both parties (Claimstream and the client) prior to providing the services. The client is responsible for providing accurate and complete details to ensure customer satisfaction.
Individual payment terms will be outlined in your service agreement with Claimstream. This will include deposit requirements, pricing, due dates and payment terms.
Upon further requests, Claimstream reserves the right to charge additional fees for requests that fall outside the original agreed scope of work.
All payments must be made in full, unless otherwise stated in your service agreement in writing, before the services are provided.
Failure to adhere to the terms of your payment may result in service delays or cancellations.
To the extent permitted by law, Claimstream disclaims all representations, warranties and conditions, express or implied. Claimstream is not liable for any indirect, incidental, or consequential damages, including loss of business, revenue, or reputation. Further, Claimstream shall not be held liable for any failure to fulfill obligations due to circumstances beyond our control. As a result of accessing our services, you assume full responsibility for any actions or decisions that you may make, including any third-party relations.
Clients agree to indemnify and hold Claimstream harmless against any claims, damages, or losses arising from their negligence or failure to comply with the terms.
This Agreement shall be governed by and interpreted in accordance with the laws of New South Wales, Australia and any disputes will be resolved in the appropriate courts within that jurisdiction.
Claimstream reserves the right to modify these Terms & Conditions at any time without prior notice. Any changes will be effective immediately upon publication on the website. Clients will be notified of any significant changes.
